Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at cometinc.ca and the Comet classroom platform (the "Service"), operated by Comet Inc. ("Comet", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Comet provides tools for in-class participation, attendance, polling, quizzing, and automatic grading, delivered through our web platform and nameplate devices. We may add, change, or remove features over time.
2. Accounts and responsibilities
To use professor features you must create an account with accurate information. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly at comet@cometinc.ca if you suspect unauthorized use.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to any account, system, or data;
- Interfere with, disrupt, or overload the Service;
- Reverse engineer, copy, or resell the Service except as permitted by law;
- Upload or enter another person's information without the authority to do so.
4. Student data and institutional responsibility
If you use the Service to collect or manage student information, you represent that you have the authority to do so and have obtained any consent required by your institution or applicable law. Comet processes classroom data on your behalf, as described in our Privacy Policy.
5. Intellectual property
The Service, including its software, design, and Comet branding, is owned by Comet Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the content and data you provide.
6. Availability
The Service is provided on an "as is" and "as available" basis. As an evolving, early-stage product, it may change and we may suspend or discontinue features or availability at any time. We do not guarantee that the Service will be uninterrupted or error-free.
7. Disclaimers
To the fullest extent permitted by law, Comet disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the fullest extent permitted by law, Comet Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Service.
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
